Vols., is reported by this office as having died Jany 28th 1865, at Govt' Hospital No. 6, Nashville, Tenn. of Chronic Diarrhoea." !29 May 1865, statement by Malinda Penny and Sarah Lasley, Hamilton Co, TN, (both signed by "x") witnessed by Henry G. Stanley and Milo M. Abbott. !29 May 1865, Widow's Claim for Pension: Mary Gann appeared before Clerk of the Circuit Court for Hamilton Co, TN, aged 44 years, resident of 11th District, widow of James Gann...that her "husband died at Nashville, TN on the 17th January A.D. 1863 in Hospital of Pneumonia or Typhoid Fever." That she was married to the said James Gann in Hamilton County on the 25 day of March 1842 by one William McGill, Justice of the Peace, that her name before marriage was Mary Penney and...that no record thereof Public or Private exists the records having been destroyed. That during the existence of the aforesaid marriage there were born to her and her said husband the following named children, who are now under the age of sixteen years, viz: Sarah Adeline Gann, born the 5th day of June 1850; James Francis Gann born on the 25th day of March 1853, Phillip Gann born on the 28th day of November 1856, all of whom are still living and reside in Hamilton County, Tenn...Her Post Office address if Chattanooga, Tennessee. !1 April 1867, "...Sarah Lasley and Malinda Penney citizens of said county who are well known to me to be respectable witnesses, who upon oath say the have for more than twenty years been acquainted with Mary Gann widow of James Gann, and was also acquainted with the said James Gann, he was a private in Company C commanded by Capt Masterson in the fifth Regt Tennessee Infantry, that the said Mary Gann has now living the following children of James Gann and herself, Sarah Adaline born June 5th 1850, James Francis born March 25th 1853, that they were present at the birth of said children and know the date thereof to be correct as so stated, they also state that there was another child of the said James and Mary Gann, named Philip born Nov 28 1856 he died on the 7th day of November 1866, leaving James Francis the only living child of the said James and Mary Gann under sixteen years of age, that they were both present and witnessed the marriage between James Gann and Mary Gann, whose name before marriage was Mary Penney they were married in 1842. "James F. who will be sixteen years of age 24 Mar 1869." !12 September 1868, "Also personally appeared Sarah Lasley and Jefferson Gann residents of Hamilton County, Tennessee, persons whom I certify to be respectable and entitled to credit and who being by me duly sowrn say that they were present and saw Mary Gann make her mark to the foregoing declaration and they further swear that they have every reason to believe from the appearance of the applicant and their acquaintance with her that this is the identical person she represents herself to be and they further swear that they have no interest in the prosecution of this claim."
